<p>Perhaps that is Taib&#8217;s perceptions, which obviously not reflecting the growing sentiment of all Sarawakians including those in his own party PBB &#8211; that he must go&#8230;.</p>

<p>All Bidayuh supporters of UMNO-PBB-Sarawak Barisan Nasional should now realise, who Michael Manyin is and how for the past few months he has been blackmailing the Dayak Community, besides shooting himselves on his foot base on the argument in the following article which appeared in Malaysian Mirror.</strong></p>

<p>On 30 August, the state of Kelantan sued the national oil corporation Petronas, for alleged breach of a contract that had been signed between Kelantan and Petronas, in 1975. With Kelantan deprived of oil royalties, its people were robbed of the benefits that could have improved their lives.</p>
<p>If this is the federal government’s way of punishing the Kelantan people for voting PAS at the state level, then BN is defeated even before it has begun. <strong>Isn’t BN bothered that it is also punishing its own supporters in Kelantan?</strong></p>
<p>The federal government treats Petronas like its personal kitty &#8211; a cash cow with which it can dip its grubby paws into, to reward those states which are compliant. The federal government is acting irresponsibly, by being spiteful and therefore, is unfit to govern.</p>
<p><strong>Kelantan (population 2,100,000) is the poorest state; Sarawak (2,500,000) is the next poorest. Both Sarawak and Kelantan are blessed with oil reserves and timber, but they remain poor. Their poverty is because of different reasons.</strong></p>
<p>Sarawak’s abundance of liquefied petroleum gas and petroleum is the mainstay of the Federal government’s economy and yet it receives only 5% royalty. Its state sanctioned logging and oil-palm industries, has resulted in massive deforestation. Only 5% of virgin jungle remains.</p>
<p>Despite the relative economic growth from timber, oil palm and oil, Sarawak still lags markedly behind the rest of the other states, bar Kelantan.</p>
<p>These two states have in common, elderly leaders who have been at the helm for decades: Taib Mahmud led Sarawak for 30 years whilst Nik Abdul Aziz Nik Mat served Kelantan since 1990.</p>
<p>But the two men, who are in their seventies, are like chalk and cheese. Taib belongs to BN whereas Nik Aziz is with PAS.</p>
<p>Apparently, after filing the suit against Petronas, Kelantan menteri besar Nik Aziz led 200 supporters in a solat hajat (prayer of need) at the nearby Federal Territory Mosque. Nik Aziz is famed for commanding support from non-Muslims in Malaysia and is instrumental in playing a leading role for the increase in popularity of PAS among non-Muslims.</p>
<p>However, the only recent suit we remember involving Taib Mahmud was the white one he wore (complete with red bow tie) on the night of the glittering high society banquet of the Islamic Fashion Festival (IFF) Charity Gala Dinner in Monaco-Monte Carlo.</p>
<p>Together with various members of Malaysian royalty and 600 guests from Monaco’s high society, Taib watched as Malaysia’s “First Lady” Rosmah Mansor, the IFF patron, donated 270,000 euros (RM1,120,961) to the Prince Albert II Foundation of Monaco. The money had been raised from the promotion of Sarawak tourism, and an auction of items including a framed signed photo of Prince Albert</p>
<p>Tok Guru, as Nik Aziz, is affectionately called, commands huge respect from several people. He interacts well with non-Muslims, because they admire him for his honesty, views on moral issues and his candour.</p>
<p>They may not agree with all of his policies, but he is valued for his wisdom and his courage.  How many in the Umno camp can match up to Tok Guru?</p>
<p>Taib Mahmud on the other hand, raised the ire of many, including a group of foreigners who joined a protest in Oxford when he went to the United Kingdom to woo investors with the ‘Sarawak Corridor of Renewable Energy’ (SCORE).</p>
<p>They were protesting at the destruction of the rainforests of Sarawak, the denial of justice for the Penan and also the construction of the 12 mega-dams project which will displace the indigenous people living in the affected areas.</p>
<p>The contrast between the two men continues on a personal level.</p>
<p>Nik Aziz lives in a modest wooden house which has no elaborate fencing, no ornate gate with security features and no sentries. His has been known to carry and use the same BIC ballpoint pen and travels in the official Proton Perdana, official registration number DBA 8668.</p>
<p>Home for Taib Mahmud is a grand riverside mansion overlooking the Sarawak River, stuffed with gilt-edged ‘Louis-Farouk’ style furniture. He, and his son, own a fleet of luxury cars including a Rolls Royce. </p>
<p>Taib has no need for car registration-number plates – those are for ordinary folk. His official car is a Mercedes 600 SEL which has no number plates, only a ‘YAB KETUA MENTERI SARAWAK’. His travelling needs would not be complete without the helicopters and a jet belonging to Hornbill Airways, specifically for his use.</p>
<p>Back in Kelantan, Nik Aziz’s religious background is complete with a religious school owned by his family, but Taib Mahmud’s greed, knows no boundaries.</p>
<p>He and his family own various multimillion properties and companies in Sarawak, the USA, the UK, Canada and Australia. These were allegedly built from the proceeds of the lucrative business deals exploiting Sarawak’s natural resources.</p>
<p>Awangku Jinal Pengiran Jawa, the PBB Youth leader said last week, that they would “vigorously oppose” any attempt to pressure Taib Mahmud to retire and that the ‘provocations and pressure’ on Taib should stop. He also questioned why people were picking on Taib when ‘other old leaders and poverty in places such as Kelantan were never questioned by certain quarters’.</p>
<p>Many people have, only he was not listening.</p>
<p>Of the two poorest states in Malaysia, one receives oil royalties, the other does not. But whilst the Chief Minister of Sarawak manages to lead a life that is way beyond his official ***RM13,000 salary and is alleged to have built a multi-million fortune and stashed it abroad, the Menteri Besar of Kelantan lives a modest life, one that speaks volumes of the man.</p>
<p>Nik Aziz, the spiritual leader of PAS, does not receive any oil royalty. Taib Mahmud who belongs to BN, does.  </p>
<p>Are Malaysians, principally the Sarawak people, content to gawp at the opulence and grand lifestyle of Taib Mahmud? Are they happy with the breach of trust?</p>
<p>Taib Mahmud is a perfect example that the route to wealth in Sarawak, (and Malaysia) is by entering politics and remaining subservient to those at the &#8216;peak&#8217;, unless one is at the &#8216;peak&#8217;, as Taib is.</p>
<p>Sadly, when they’re there, they can be a law unto themselves.</p>

		<description><![CDATA[人民公正党浮罗岸州立法议员黄锦河律师表示，担任一州之主近30年，仍不能掌握各族群的权益，包括还不了解华人要什么，这个首席部长实在应该引退了。 他说，众所周知，国阵成员党各代表各个族群而成立联合政府，如果这个联合政府的最高领袖都不明白各族群的权益，这个联合政府肯定出了大问题。 砂州群众也难以对一个内部出现大问题的联合政府再寄以厚望，因此同样的，砂州国阵也应该随着最高领袖的引退而下台。 黄锦河今日针对砂州首席部长丕显斯里泰益玛目的去留问题发表他的意见。 他认为，砂拉越最高层领袖不了解各族群权益，不仅是砂国阵各成员党的党内沟通问题这么简单。 黄锦河说，这是砂国阵各成员党之间的权利分配出现极大悬殊，造成一党或一人独大的现象。 他说，如果一个联合政府，各成员党没有平起平坐的执政权，或将沦为独裁政权，不利于民主政治的发展。 尤其是国阵，各成员党代表各族群，如土著保守党代表马来族，砂人民党与砂民主进步党代表砂州的达雅族群，而人联党代表砂州华人参政。 目前的砂国阵政府，表明上看来是联合所有族群代表性政党，来组成的联合政府，说的好听是联合所有族群组成的政府。 实际上，这种联合没有超越种族政党政治，反而是有成立一个新的种族政治团队之嫌。 黄锦河说，有种族政治团队之嫌的联合政府，为了巩固选票基础，仍然难逃各成员党只捍卫各代表族群的权益。 这种国阵联合政府的方程式，还是把砂拉越族群分而治之或各自争之，并不符合马来西亚及砂拉越多元种族，多元文化的实质。 他强调，经过了47年的独立，马来西亚人民还要面对种族斗争局面，距离多元种族社会与全民团结渐行渐远，这不是砂拉越人民所要看到的独立成果。 任何造成种族斗争的联合政府，是否能确保所有族群利益？这是受到质疑的，尤其是联合政府有一党独大的现象，成员党在当家不当权的窘境，很难有效为他们的族群争取权益。 在这种执政权力分配不均的制度下，会出现砂拉越某一族群的权益，包括华人所要的都不被砂国阵高层所了解，这是不会令人惊奇的。 黄锦河指出，简单的说，一党独大的国阵政府只有联合政府之名，却没有联合政府之实，有名无实的联合政府不能为所有族群带来基本利益。 除非联合政府所有成员党都享有平等的权利分配，平起平坐，各族群的权益才能受到平等对待。 但在目前的砂州国阵联合政府内，看不到有平等执政权利的分配。 黄锦河认为，因此才造成某一成员党在联合政府内没有实权，也才会导致该成员党所代表的族群权益不受到关注与重视。 如果让这个一党独大的执政团队继续领导砂拉越，砂州的种族斗争将更恶化，真正多元族群社会的目标将更遥远。 为了砂拉越的多元种族及全民团结的前途，首席部长必须引退，这个一党独大的国阵政府必须下台。]]></description>

<p>尤其是国阵，各成员党代表各族群，如土著保守党代表马来族，砂人民党与砂民主进步党代表砂州的达雅族群，而人联党代表砂州华人参政。</p>
<p>目前的砂国阵政府，表明上看来是联合所有族群代表性政党，来组成的联合政府，说的好听是联合所有族群组成的政府。</p>
<p>实际上，这种联合没有超越种族政党政治，反而是有成立一个新的种族政治团队之嫌。</p>
<p>黄锦河说，有种族政治团队之嫌的联合政府，为了巩固选票基础，仍然难逃各成员党只捍卫各代表族群的权益。</p>
<p>这种国阵联合政府的方程式，还是把砂拉越族群分而治之或各自争之，并不符合马来西亚及砂拉越多元种族，多元文化的实质。</p>
<p>他强调，经过了47年的独立，马来西亚人民还要面对种族斗争局面，距离多元种族社会与全民团结渐行渐远，这不是砂拉越人民所要看到的独立成果。</p>
<p>任何造成种族斗争的联合政府，是否能确保所有族群利益？这是受到质疑的，尤其是联合政府有一党独大的现象，成员党在当家不当权的窘境，很难有效为他们的族群争取权益。</p>
<p>在这种执政权力分配不均的制度下，会出现砂拉越某一族群的权益，包括华人所要的都不被砂国阵高层所了解，这是不会令人惊奇的。</p>
<p>黄锦河指出，简单的说，一党独大的国阵政府只有联合政府之名，却没有联合政府之实，有名无实的联合政府不能为所有族群带来基本利益。</p>
<p>除非联合政府所有成员党都享有平等的权利分配，平起平坐，各族群的权益才能受到平等对待。</p>
<p>但在目前的砂州国阵联合政府内，看不到有平等执政权利的分配。</p>
<p>黄锦河认为，因此才造成某一成员党在联合政府内没有实权，也才会导致该成员党所代表的族群权益不受到关注与重视。</p>
<p>如果让这个一党独大的执政团队继续领导砂拉越，砂州的种族斗争将更恶化，真正多元族群社会的目标将更遥远。</p>
<p>为了砂拉越的多元种族及全民团结的前途，首席部长必须引退，这个一党独大的国阵政府必须下台。</p></div>

<p><strong>UNMET HEALTH CARE NEEDS, SARAWAK, 2010</strong></p>
<p><strong>PARTI KEADILAN RAKYAT : ACT NOW ON MEDICAL SERVICES IN SARAWAK &#8212;-HOSPITALS !</strong></p>
<p>SUMMARY: In a second part discussion paper, Parti KeAdilan Rakyat in Sarawak has demanded that several new hospital projects be approved for Greater Kuching and Bandar Sri Aman under the 10th Malaysia Plan, and to be carried over into the 11th Malaysia Plan. Further Sibu GH and Miri GH should be upgraded to Central Region and Northern Region, Regional Hospitals on par with Sarawak General Hospital. Several other Divisional and District Hospitals should provided the minimal resident Specialist services within 3-5 years.</p>
<p>A total developmental allocation of RM 1.5 billion is sought, and increased annual operating expenditure of new and upgraded hospitals will have to be budgeted accordingly. This estimate is in addition to development and operational funds needed for new and better polyclinics proposed in the first part of the discussion paper released recently.</p>

<p>New hospital projects and upgrade of services of existing divisional and district hospitals have been successively canvassed by Parti KeAdilan Rakyat in Sarawak since 2006, both inside and outside Dewan Undangan Negeri. We have even appealed for fast-tracked budgetary approval, but other than the ON-OFF promise for PetraJaya GH, there has been no meaningful and substantive response from State and Federal Governments.</p>
<p>A. New general hospital projects needed:</p>
<p>Greater Kuching:</p>
<p>PetraJaya-Bako-Santubong : 400 beds<br />
Batu Kawa-Moyan : 250 beds<br />
Padawan- Siburan : 350 beds<br />
“SIMC” Samarahan : increase from 200 to 350 beds is sought.</p>
<p>Sri Aman Division<br />
Sri Aman 300 beds, option to increase to 400.</p>
<p>B. Up-grade of Sibu and Miri General Hospital<br />
Upgrade to function as Regional Referral Hospitals providing tertiary services.</p>
<p>C. Divisional and District Hospitals upgrade<br />
Upgrade to provide bare minimal Specialist services:<br />
Sri Aman, Sarikei, Kapit, Mukah, Limbang<br />
Serian, Marudi.</p>
<p>D. Promised Lawas Hospital extension, repeatedly delayed.<br />
Promised SGH car park, deferred.</p>
<p>FUNDING NEEDED:</p>
<p>Costing: 4 New Specialist GH: RM 250-350 million each<br />
Doubling the beds at “SIMC” RM 100-120 million<br />
Upgrade of Sibu and Miri GH: RM 50-60 million each<br />
Upgrade of Divisional and District Hospitals: RM 10-30 million each<br />
Promised but delayed upgrade of Lawas Hospital RM 120 million</p>
<p>Total funding needed: Appox. RM 1.5 billion, spread over the project period of 10th and 11th Malaysia Plans.</p>
<p>(Prices barring further exceptional inflationary hikes; the cost could rise 20-30 % when universal minimal wage is adopted, GST kicks in and subsidies eliminated totally, in addition to foreign inflationary impact.)</p>
<p>The annual operational funding requirements for all hospitals in Sarawak following the commissioning of the new facilities and services would likely increase by 2-3 times from 2015-2020. For large hospitals, the operational cost would have outstripped capital cost in 3-4 years.</p>
<p>Our statement in April 2008 needs to be repeated: “The under-provision versus service needs in Kuching and other towns will get worse if no aggressive proactive planning is undertaken immediately. Apart from the rapid urban population growth which is underpinned by rural-urban migration, the slowly but steadily aging population adds to the service needs. Increasing morbidity from “lifestyle diseases”, cancer, road traffic accidents, geriatric states and mental states will stress both acute and chronic care services. The demographic and morbidity patterns as well as city development patterns have not been sufficiently attended to in public medical services planning and development.”</p>
<p>Sarawak covers an area larger than Peninsular Malaysia, but the single trunk road from Kuching to Miri is not up to the standard of an express highway. Some districts in the central and northern regions are each equivalent in size to several smaller states of peninsular Malaysia put together. This impedes even physical access to general hospitals, especially timely access in times of acute illnesses.</p>
<p>Physical access of rural remote communities by land and river transport to Sibu, Miri and Bintulu general hospitals are difficult enough, what more access to Sarawak GH in Kuching at the southern end of Sarawak.</p>
<p>The national doctor: population target is 1: 500, but in Sarawak it is 1: 1000+, this even a camouflage of the urban-rural disparity. The ratio is expected to greatly improve in 3-5 years, given the large numbers of medical graduates joining the service.</p>
<p>A. The Sarawak General Hospital is the sole regional referral hospital in Sarawak providing tertiary level care. The secondary regional needs of the South West , Central and Northern Regions of Sarawak are served by SGH, Sibu GH and Miri GH, all with large hinterland catchments respectively.</p>
<p>SARAWAK GENERAL HOSPITAL providing 800 beds is the State Hospital, also serving as the teaching hospital. Its congestion in recent years is evident in the wards, the Accidents and Emergency Department, the Specialist Out-patient Clinics, the hospital lobby, the Pharmacy, the service roads, the car parks, the public lifts, etc. Built in the late 1960s, it has undergone 2-3 major upgrades, with added services, clinic and ward blocks and an increase in beds from about 600 to 800.</p>
<p>(A multi-storey SGH car park costing RM 20 million put up under the 9th Plan was deferred to the 10th MPlan, due to urgent priorities at Kota Kinabalu).</p>
<p>While patients needing tertiary level care are sent in from the General Hospitals of Sibu, Miri and Bintulu, and also directly from some District Hospitals of Sarawak, some local Kuching patients are decanted off to the Sentosa Mental Hospital 6 miles away and the Rajah Charles Brooke Hospital, a disused leprosarium some 12 miles away. There were even occasional patients sent off to Serian District Hospital. These “decompression” maneuvers have expectedly impacted on operational cost and given considerable logistical pressure for the hospital administration, not to mention the hardship on patients and relatives.</p>
<p>The immediate primary and secondary catchment consists of the South West Region of Sarawak, namely the Kuching, Samarahan, Sri Aman and Betong Divisions.</p>
<p>The conversion of the failed Sarawak International Medical Centre at Kota Samarahan to a government tertiary specialist and general hospital will add another 200 beds to Greater Kuching It is expected to open in 2011, with emphasis on providing cardiology and cancer care.</p>
<p>The site has ample land space for future new services and wards blocks much needed. The fastest way to add beds to Kuching would indeed be to build additional ward blocks, increasing its bed strength to 300-350 beds. These additional blocks would be for standard general wards like maternity and paediatrics, surgery and orthopaedics, general medical etc. They may become operational 5-6 years after budget approval. (Technically, it may interest protagonists in the debate about cost per bed at SIMC, that doubling the bed strength would very substantially reduce the cost per bed to well below RM 2 million per bed, although RM 100 million or more new capital may need to be pumped in.)</p>
<p>The need for 3 other new general hospitals in Greater Kuching within the next 10-15 years run parallel to the need for primary care facilities outlined in Part 1.</p>
<p>The gestation period of hospitals is very long. A new general hospital project, if approved under the 10th Malaysia Plan (2011-2015), will only see its commissioning for public service in 2020, if not even later.</p>
<p>B. The 200 bedded Sri Aman Hospital built in the 1950s, is out-dated and cramped, even inadequate and unsatisfactory in the 1980s. Ambulances run several sorties to SGH in Kuching, on the bumpy 200 Km Sri Aman-Serian-Kuching Road. Ambulance runs are costly and personnel intensive (min.1 driver 1 medical staff to 1 patient), and the rough ride of 200Km endangering the critically ill patient.</p>
<p>In a recent communicable disease out-break, it has the notorious reputation of suspected victims being placed under a tent under a tree in the car park !</p>
<p>The hospital has a catchment population of about 200,000. Basic resident specialist services, perhaps 6-8 clinical disciplines are needed. However, the old ward blocks at a cramped site is not suitable for renovations to house modern specialist departments and service blocks, like A&amp;E, ICU , operating suites, maternity suite and nursery, imaging department, physiotherapy department, etc.</p>
<p>C. Sibu General Hospital has a large catchment consisting of virtually the whole Rajang River (350Km) basin, the Rajang-Igan Delta and Coastal Mukah Division. Much of the SCORE activity is in the catchment.</p>
<p>D. Miri General Hospital has a similarly large catchment consisting of the Baram region and the Limbang Divisions. Much of the oil and gas activities fall within the catchment of Miri and Bintulu General Hospitals.</p>
<p>Basic specialist services are provided at Miri and Sibu Hospitals. Due to the size of the catchment population of between 500,000 to 1 million, the burden of disease figures, the inconvenience and increasing cost of air transport to go to Kuching for patients and escorts, they should be upgraded to Regional Hospitals providing comprehensive basic specialist services and tertiary care in more clinical disciplines. The growing population in the primary and secondary catchment areas means that new tertiary care services will have the economies of scale.</p>
<p>The tertiary services proposed should initially include cardiology, cancer and radiotherapy, nephrology and urology, psychological medicine, burns, neurology, gastroenterology, etc. Thus some of the medical technology now made available in Kuching should be similarly made available to residents of the Central and Northern Regions of Sarawak.</p>
<p>The gestation period for upgrading to tertiary and sub-specialiaty services would be about 5 years for them to be brought into service.</p>
<p>D. Bintulu GH to an extent serves the regional needs of Kemana, Tatau, Bakun. It should have the basic 8 or 9 clinical disciplines. A CAT scan privately donated is not being timely used due to absence of a specialist radiologist.</p>
<p>District and Divisional Hospital Upgrades</p>
<p>It must be noted that some District Hospitals in Peninsular Malaysia had a few minimal<br />
resident Specialists even in the early to mid 1970s, certainly in such places as Banting, Batu Pahat and Kluang.</p>
<p>District and Divisional Hospitals in Sarawak are generally staffed by young doctors after 2-3 years of training, and are not expected to be able to handle a whole range of emergency conditions in the community. The hospitals are visited periodically by Specialists from general hospitals, but acute emergencies do not just happen during their visits! Moreover the specialists may not themselves be able to deal fully with some of the emergencies in district hospitals, lacking equipment and facilities, as well as the necessary treatment teams.</p>
<p>Initially, Serian and Sarikei should set up Medical, general surgical, OBGY, Paediatrics Departments with resident specialists, and Kapit, Mukah, Marudi, and Limbang, just Medical and General Surgical Departments. Renal dialysis needs will have to be separately assessed at Divisional and some district hospitals, as the need is increasing rapidly.</p>
<p>Further service needs at other district hospitals have yet to be assessed by us in terms of potential workload and respective economy of scale.</p>
<p>The posting of specialist doctors to Divisional Hospitals generally raises both clinical, nursing and ancillary service standards at these hospitals. Continuing medical education and on-job training of junior medical staff is enhanced.</p>
<p>Adoption of the above proposals would go a long way to address the inpatient care needs of Sarawak for the next 2 decades or more, this barring exceptional population increases arising from non-medical macro-policies.</p>
<p>Services would thus have been upgraded in terms of quality and depth, as well as scope, throughout the major regions of Sarawak, based on regional and local population needs. In so doing, the government of the day would be advancing an important principle in health care, that of more equitable distribution of health care resources, at both national and state levels.</p>
<p>( It is realized that there is need to provide for other residential/inpatient services or expanding their scope, including in psychological medicine, and rehabilitative and nursing homes, but these are large subjects, better dealt with at another time.)</p>

<p>In other countries the best brains, especially in law (judiciary) and economics work for the government.</p>
<p>In Malaysia, after watching the inquest and DPP Abdul Razak Musa (MACC’s lawyer) questioning Dr Pornthip, you decide whether in Malaysia, the government attract the best brains to serve or otherwise.</p>
<p>Since the hilarious questioning by DPP Abdul Razak Musa and Dr Pornthip’s testimony, the news, transcripts and video have been much sought after with searches coming in via google and from around the world. Overnight, DPP Abdul Razak Musa have become a celebrity, but for the wrong reason.</p>
<p>This has added another feather to MACC&#8217;s cap and illustrious reputation.</p>
<p>If justice must be seen to be delivered, DPP Abdul Razak Musa certainly have added a more charismatic twist to it with his near comical line of questioning to convince the Coroner that Dr Pornthip is not credible. Will he succeed? Remember we are in Boleh Land!</p>

<p>The Courts have decided .. this is what Utusan Melayu, The Star, Malay Mail will scream when the verdit is delivered (anticipated) soon.</p>
<p>Justice must be seen to be delivered and this may not be the case here.</p>

<p><strong>It is strange that in the 21st century, we are still having to face the problem of institutionalised racism.</strong></p>
<p>OVER the past week or so, there have been some developments in our country which are more disturbing than usual.</p>
<p>In particular, the two cases of alleged racist remarks by school heads; the accusations that Penang mosques have replaced the Yang di-Pertuan Agong with the Chief Minister’s name in their prayers; and the continued insistence that Article 153 of the Constitution is equal to an inalienable right that could not be questioned.</p>
<p>These events are interrelated and it seems to me that they indicate that there is a battle of ideology going on in the country now.</p>
<p>On one side is the idea that a person’s ethnicity and religion entitles him to be treated better than anyone else who is different. On the other side is the idea that equality is an aspiration that is both noble and necessary for nation building.</p>
<p>It is strange that in the 21st century we are still having to face the problem of institutionalised racism.</p>
<p>Looking at our history, one can see why this has occurred. The combination of race-based politics and poorly interpreted constitutional provisions have meant that the idea of racial and religious superiority has been allowed to grow and become the norm rather than something undesirable and out of the ordinary.</p>
<p>How else can one explain the possibility that teachers, the very people to whom we entrust the education of our children, can have such warped values and also have the gall to express those views publicly?</p>
<p>How else can we explain the near rabid attack on the Penang Chief Minister for something which he and the state religious department have vehemently denied and in fact would have been insane to attempt?</p>
<p>Let’s analyse this one step at a time. When the dominant political parties in this country do not have any political ideology to speak of and are instead, based on the principle that each race-based component has a duty to safeguard the interest of its community, what one has is a recipe for the kind of policy and rhetoric that divides rather than unites.</p>
<p>Historically, one can see the reasons why the politics of the nation was forged in this way. It was a necessary evil in the face of the divide-and-rule policy by the British to show that even when separate, the three major communities of the nation can still work together politically.</p>
<p>However, it is an unsustainable model and what started life as a fairly rosy example of racial cooperation too easily descended into crude racialist type politics.</p>
<p>Which is why the early aspirations that our founding fathers had for a society treated with equality has now been all but buried by the idea that one race is superior to others and in fact is the only race with any right to be here in Malaysia.</p>
<p>This is because in the battlefields of politics, it is easiest to appeal to base racialist emotions, especially when without those types of ideas, a party based on race will have no collateral to work with.</p>
<p>In this kind of political atmosphere, it is of no surprise that what has been forgotten is that the basis of this nation was one of justice and equality. And the document that is meant to protect that, the Federal Constitution, has been misinterpreted to the extent that there is no longer any trace of this aspiration in the mainstream discourse of the day.</p>
<p>Let us be absolutely clear on this matter, the Constitution does give powers to the government to take affirmative action and it does acknowledge the fact that Islam has a special place in the public life of the nation.</p>
<p>What it does not intend to do however is create a perpetual system of ethnic-based favourable treatment nor does it advocate the idea that all other religious beliefs must be subservient to Islam.</p>
<p>However, instead of this reasonable position, what we have today is the idea that affirmative action for Malays is unquestionable and to be continued in perpetuity becoming the norm.</p>
<p>This cannot be further from the truth as there are no legal justification for it at all.</p>
<p>Article 153 of the Federal Constitution is seen as the holy grail for those who hold this view. However, if we examine the provision closely we will notice two things.</p>
<p>Firstly, affirmative action is not a Malay right. Article 153 does not endow a right. What it does is to merely give government the power to take affirmative action despite the overarching ideal of equality which is enshrined in Article 8 of the Constitution.</p>
<p>To support this contention, we see that Article 8 clearly states that all citizens in this country are equal except for situations specifically provided for in the Constitution. Those “specific provisions” are found in Article 153 and there are not many of them.</p>
<p>They include the power to establish quotas for the civil service, permits and licences, scholarships and education.</p>
<p>Therefore anything other than these areas should not be subjected to affirmative action.</p>
<p>Furthermore, any affirmative action has to be reasonable. The idea of what is reasonable must surely be open to research and debate otherwise there will always be the risk of abuse and wastage of resources.</p>
<p>This being the case, although questioning the existence of such a power to have affirmative action is moot, discussion on the efficacy of affirmative action policies and programmes surely is not.</p>
<p>The way the discourse is today, and not merely by the racialist fringe but by mainstream politicians in power, is that even the implementation of Article 153 is not to be questioned at all.</p>
<p>This is surely wrong based both on the meaning of the Constitution as well as the principle held by the founding fathers that Article 153 was an unfortunate but necessary aberration from the ideals of equality and that it was to be used not in perpetuity.</p>
<p>With these kinds of distortion of law, is it any wonder then that we still get people actually classifying whole swathes of the citizenry as having no right to be here?</p>
<p>Is it any wonder then that a crazy accusation against a Chief Minister whose government has given twice as much money to the Islamic bodies in the state than the previous administration, can give rise to the belief that he is a threat to the faith?</p>
<p>If this country is to have any future as a true nation, the time has come for those who believe in the ideals of equality, ideals which were held by the political founding fathers of the country as well as the traditional Rulers of that time, to stand up and be counted.</p>
<p>To not be cowed by the bigots and to say that this is our country and it stands on noble humanitarian ideals, not opportunistic racialist thinking.</p>
